PRODUCT DESCRIPTION AND ANALYSIS

The product under consideration is a modular industrial facility designed to convert natural gas into Liquefied Natural Gas (LNG) by purifying, compressing, cooling, and liquefying natural gas to approximately –160°C, thereby reducing its volume by about 600 times for efficient storage and transportation.

Based on the submitted technical documentation, the plant consists of interconnected process, refrigeration, storage, utility, and safety systems that operate together as a single functional unit to produce LNG. The major systems and their respective functions are outlined below.

S/NSystem/ComponentsFunction
1Feed Gas Filter, Two-Phase Separator, Feed Gas CompressorRemoves solid contaminants, separates free liquids (water and condensate), and compresses the natural gas to the required process pressure for downstream treatment and liquefaction.
2Fuel Gas Surge Drum; Amine Contactor, Flash Drum, Sweet Gas Air Cooler, Sweet Gas Separator, Lean Amine Charcoal Filter, Rich/Lean Heat Exchanger, Amine Stripper, Stripper Reboiler, Acid Gas Air Cooler, Acid Gas Separator, Lean Amine Air Cooler, Lean Amine Pump, Amine SumpRemoves acid gases, principally carbon dioxide (CO₂) and hydrogen sulphide (H₂S), using an amine absorption process. The amine solution is continuously regenerated and recycled, protecting cryogenic equipment from corrosion, hydrate formation, and reduced LNG quality.
3Pre-cooling Heat Exchanger, After-Precooling Separator, Dehydration Column, Regeneration Gas Heater, Air Cooler, Separator, Demercuration Column, Dust FilterRemoves water vapour and elemental mercury. Molecular sieves eliminate moisture to prevent ice formation, while mercury adsorbents protect aluminium cryogenic heat exchangers from mercury-induced corrosion.
4Heavy Hydrocarbon Pre-cooling Heat Exchanger, Heavy Hydrocarbon Removal Bed, Regeneration System, Dust FilterRemoves heavy hydrocarbons (C₅⁺ and aromatics) that could freeze under cryogenic conditions and impair heat exchanger performance. Adsorbent beds are periodically regenerated.
5Pre-cooling Heat Exchangers and Mixed Refrigerant (MR) Low-Temperature Separators (Cold Boxes A & B)Provides the initial cooling of the feed gas using mixed refrigerant while maintaining refrigerant quality through phase separation.
6Cold Box A (Liquefaction Heat Exchanger, Heavies Separator, Flash Drums, Residual Liquid Heater, Vent Vaporizer)Performs the first stage of cryogenic cooling and partial liquefaction. Mixed refrigerant absorbs heat from the natural gas while separators optimize refrigerant circulation and remove residual condensable hydrocarbons.
7Cold Box B (Liquefaction Heat Exchanger, Sub-cooling Heat Exchanger, Flash Drums, Separators)Completes liquefaction and sub-cools LNG to approximately –160°C, ensuring stable LNG production and efficient refrigerant circulation.
8LNG Storage TankStores LNG under cryogenic, low-pressure conditions while minimizing heat ingress and boil-off gas generation.
9Mixed Refrigerant (MR) Dehydrator, Ethylene Vaporizer, MR Proportioning DrumsDries, vaporizes, and proportionally blends refrigerant components to maintain the required refrigerant composition for efficient refrigeration.
10LNG Loading Pump and Loading ArmTransfers LNG safely from storage tanks into road tankers, ISO containers, or marine vessels while minimizing product losses.
11Heavy Hydrocarbon Heater, Electric Heater, Storage Tank and Loading ArmCollects, stores, heats (where necessary), and transfers recovered heavy hydrocarbons for transportation or disposal.
12Boil-off Gas (BOG) Heater and Roots FanRecovers boil-off gas generated during LNG storage by compressing and reheating it for reuse as plant fuel or reinjection into the process, thereby reducing product losses and emissions.
13Sewage Tank and Flare SystemProvides environmental protection and operational safety by collecting wastewater and safely combusting excess hydrocarbons released during startup, shutdown, or emergency conditions.
14Demineralized Water and Softened Water SystemsProduces high-quality process water by removing hardness minerals and dissolved salts for utility and process applications, preventing scaling, corrosion, and fouling.
15Instrument Air and Nitrogen UnitSupplies clean, dry compressed air for pneumatic instruments and nitrogen for purging, inerting, pressure testing, blanketing, and maintenance operations.
16Thermal Oil UnitCirculates heated thermal oil to provide indirect process heating for regeneration systems and other process equipment requiring controlled high-temperature heat.
17Feed Gas Compressor UnitCompresses incoming natural gas to the pressure required for continuous and stable plant operation.
18Propane Compression and Condensing UnitCompresses, condenses, and recycles propane refrigerant used in the pre-cooling stage of the refrigeration cycle.
19Mixed Refrigerant Compressor Units (Cold Box A, Cold Box B Hot-End and Cold-End)Compresses mixed refrigerant through multiple refrigeration stages, enabling condensation, expansion, and evaporation to generate the cryogenic temperatures necessary for LNG liquefaction.
20Gas Generator Set UnitGenerates electrical power using natural gas to supply compressors, pumps, instrumentation, control systems, lighting, and other essential plant equipment where grid power is unavailable or as standby generation.

Collectively, these interconnected process, refrigeration, storage, utility, and safety systems constitute a complete natural gas liquefaction plant designed to perform the single, clearly defined function of converting natural gas into liquefied natural gas (LNG). Although imported in multiple consignments due to its modular design, the equipment forms one integrated functional unit whose principal purpose is the liquefaction of natural gas.

TARIFF CLASSIFICATION

Based on the product description and the functions of the various components, the 7 MMSCFD Natural Gas Liquefaction Plant comprises a combination of interconnected machines and equipment that collectively perform the clearly defined function of processing natural gas into liquefied natural gas (LNG). The integrated components operate together to purify, compress, cool, and liquefy natural gas while maintaining the required gas quality and process conditions.

Accordingly, pursuant to General Rule of Interpretation (GIR) 2(a), the unassembled or disassembled components, when presented in multiple consignments for assembly into a complete plant, retain the essential character of the finished machine and are therefore classifiable as the complete natural gas liquefaction plant. Furthermore, as the assembled equipment constitutes a combination of machines performing a single clearly defined function, its classification is also supported by Note 4 to Section XVI of the Harmonized System which provides that:

"Where a machine (including a combination of machines) consists of individual components (whether separate or interconnected by piping, transmission devices, electric cables or other devices) intended to contribute together to a clearly defined function covered by one of the headings in Chapter 84 or Chapter 85, then the whole falls to be classified in the heading appropriate to that function,"

the complete plant is classified according to its principal function, namely the liquefaction of natural gas.

Consequently, the 7 MMSCFD Natural Gas Liquefaction Plant properly falls under Heading 84.19, covering:

"Machinery, plant or laboratory equipment, whether or not electrically heated (excluding furnaces, ovens and other equipment of heading 85.14), for the treatment of materials by a process involving a change of temperature such as heating, cooking, roasting, distilling..."

Specifically, the plant is classified under Tariff Subheading 8419.60.00.00 – Machinery for liquefying air or other gases, attracting 5% Import Duty and 0% VAT in accordance with the ECOWAS Common External Tariff (CET) 2022–2027.
