TARIFF CLASSIFICATION
- HIGH-DENSITY POLYETHYLENE (HDPE)
Note 1 to Chapter 39 defines the expression “plastics” as materials of headings 3901 to 3914 which are, or have been, capable, either at the moment of polymerisation or at some subsequent stage, of being formed under external influence—usually heat and pressure, if necessary, with a solvent or plasticiser—by moulding, casting, extruding, rolling or other processes into shapes which are retained upon removal of the external influence.
Furthermore, Note 6(b) to Chapter 39 provides that, in headings 3901 to 3914, the expression “primary forms” applies to “blocks of irregular shape, lumps, powders (including moulding powders), granules, flakes and similar bulk forms.”
The Explanatory Note (EN) to Chapter 39, under the description of primary forms, further explains that powders, granules and flakes in primary forms are generally employed for moulding and other processing operations.
Also, the 2nd paragraph of the Explanatory Note to heading 3901 defines high-density polyethylene (HDPE) as polyethylene having a specific gravity at 20 °C of 0.94 or more.
Based on the foregoing provisions and the product characteristics, the product falls under heading 3901 – Polymers of ethylene, in primary forms, and properly classified under tariff subheading 3901.20.00.00 – Polyethylene having a specific gravity of 0.94 or more, at a 5% rate of duty, 7.5% VAT and 5% Import Adjustment Tax (IAT), in accordance with the ECOWAS Common External Tariff (CET) 2022–2027, Note 1, 6(b), and the EN to Chapter 39, Paragraph 2 of the EN to heading 3901)
2. POLYVINYL CHLORIDE (PVC)
Based on the Technical Data Sheet submitted, the product consists of approximately 99% polyvinyl chloride polymer, with a trace amount of residual vinyl chloride. The product is presented in powder form and is not mixed with any other substance.
Note 6(b) to Chapter 39 provides that the expression “primary forms” applies to “blocks of irregular shape, lumps, powders (including moulding powders), granules, flakes and similar bulk forms.”
In view of the above, the product, being polyvinyl chloride resin presented in powder form and not mixed with any other substance, falls within heading 3904 – Polymers of vinyl chloride or of other halogenated olefins, in primary forms.
Accordingly, the product is properly classified under tariff subheading 3904.10.00.00 – Poly (vinyl chloride), not mixed with any other substances, at a 5% rate of duty and 7.5% VAT, in accordance with the ECOWAS Common External Tariff (CET) 2022–2027 and Note 6(b) to Chapter 39.
3. PIGMENT – OPTICAL BRIGHTENER OB-1
Based on the product analysis, Optical Brightener OB-1 is a synthetic organic colouring matter of the stilbene type, used principally as a fluorescent brightening agent.
Note 3 to Chapter 32 provides that “Headings 32.03, 32.04, 32.05 and 32.06 apply also to preparations based on colouring matter (including, in the case of heading 32.06, colouring pigments of heading 25.30 or Chapter 28, metal flakes and metal powders), of a kind used for colouring any material or used as ingredients in the manufacture of colouring preparations.
Furthermore, Item l(e)(3) of the Explanatory Note to Chapter 32 includes stilbenes among the various types of synthetic organic colouring matter classified in heading 3204, whether as dyes or pigments.
